These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and ExecShot ("Company", "we", "us", or "our") regarding your use of the ExecShot online service (the "Service"). By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to all of these Terms, you may not access or use our Service.
ExecShot is an online software service that uses artificial intelligence technology to generate professional executive headshots based on user-uploaded reference photos. Our Service offers:
You must be at least 18 years of age to use this Service. By using our Service, you represent and warrant that you are at least 18 years old and have the full right, power, and authority to enter into this agreement.
To use our Service, you must create an account through Google Sign-In. We only support Google authentication for account creation and login.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
We reserve the right to terminate or suspend your account at any time for violation of these Terms. You may delete your account and all associated data through the Profile tab in our application.
We offer two one-time payment plans:
Users may purchase additional generation credits for $49.99 USD, which provides 100 additional custom generations or regenerations.
All payments are processed through Stripe, a third-party payment processor. Your payment information is handled in accordance with Stripe's terms and privacy policies.
ALL SALES ARE FINAL. WE DO NOT PROVIDE REFUNDS FOR ANY REASON. We believe in our service quality and therefore maintain a strict no-refund policy.
You may upload 1-3 reference images of yourself to use our Service. You represent and warrant that:

You must maintain at least one reference image in your account at all times during your subscription period. If you have only one reference image, you cannot delete it through the standard deletion process.
You retain full ownership and rights to all images generated through our Service. We do not claim any ownership rights to your generated content.
You retain full ownership and rights to all reference images you upload. We only use your reference images to generate your requested images and for no other purpose.
The ExecShot Service, including our software, algorithms, and user interface, is owned by us and protected by intellectual property laws.
User accounts and all associated data, including reference images and generated images, are stored for 30 days from account creation or last activity.
After the 30-day retention period, user accounts and all associated data may be permanently deleted from our systems.
Any remaining generation or regeneration credits in your account will be lost after the 30-day retention period, regardless of when they were purchased.
You may delete your account and all associated data at any time through the Profile tab in our application.
We use third-party artificial intelligence services to generate images. While we maintain high standards for our technology partners, we do not guarantee the perfection of AI-generated content and are not responsible for any limitations or biases in the underlying AI models.
We strive to maintain continuous service availability but do not guarantee uninterrupted access to our Service.
While we aim to provide high-quality generated images, AI technology has limitations. Generated images may not always meet your expectations, and results may vary.
You use generated images at your own risk. We are not responsible for how you choose to use the generated content or any consequences thereof.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL EXECSHOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.
You agree to defend, indemnify, and hold harmless ExecShot and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from your use of our Service or violation of these Terms.
These Terms shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law provisions.
We reserve the right to modify these Terms at any time. We will notify users of any material changes via email or through our Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and ExecShot regarding the use of our Service.
